1. Acceptance of Terms

By downloading, accessing, or using Your Season Guide ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Your Season Guide is a mobile application that provides personalized seasonal color analysis using artificial intelligence. The App analyzes photos you provide to determine your seasonal color palette and offers style recommendations.

3. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement.

4. Account Registration

When you create an account using Sign in with Apple, you agree to:

• Provide accurate information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

5. Subscription Terms

5.1 Free Trial

New subscribers may be eligible for a 3-day free trial. During the trial period, you have full access to premium features at no charge.

5.2 Subscription Plans

• Weekly Subscription: £9.99 per week
• Subscriptions include up to 5 color analysis guides per week
• Access to complete color palettes, AI-edited photo previews, and style recommendations
• Downloadable PDF guides
• Cross-device synchronization

5.3 Billing

• Payment will be charged to your Apple ID account at confirmation of purchase
• After the free trial (if applicable), your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• The renewal cost equals the current subscription price

5.4 Cancellation

• You may cancel your subscription at any time through your Apple ID account settings
• Go to Settings > [Your Name] > Subscriptions on your iOS device
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods

5.5 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to subsequent billing periods.

6. User Content

6.1 Photo Uploads

When you upload photos for analysis:

• You retain ownership of your photos
• You grant us a limited license to process your photos for the purpose of providing color analysis
• Photos are processed securely and deleted immediately after analysis
• We do not store, share, or use your photos for any other purpose

6.2 Acceptable Use

You agree not to:

• Upload photos containing illegal content
• Use the App for any unlawful purpose
• Attempt to reverse engineer the App
• Interfere with the App's operation or security

7. Intellectual Property

The App, including its design, features, content, and AI technology, is owned by Your Season Guide and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. AI-Generated Content

8.1 Nature of Service

Color analysis results and recommendations are generated using artificial intelligence. Results are provided for informational and entertainment purposes.

8.2 No Guarantee

We do not guarantee the accuracy, completeness, or suitability of AI-generated recommendations. Individual results may vary based on photo quality, lighting conditions, and other factors.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OF RESULTS

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUR SEASON GUIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• LOSS OF PROFITS OR DATA
• PERSONAL INJURY
• PROPERTY DAMAGE

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Your Season Guide, its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Modifications to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms. We will notify you of material changes through the App or via email.

13. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the App ceases immediately
• Active subscriptions will not be refunded
• You may request deletion of your account data

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
